Subscription's T&Cs

The website (hereinafter referred to as “OZERTY”), is published at the address https://ozerty-canada.com.

ARTICLE 1 : Definitions

In order to facilitate the readability of these Subscription T & Cs, the following terms will always have the meaning and scope conferred on them in this article.

Terms	Definitions
T & Cs	Refers to these Terms and conditions of the suscription.
User Account	Refers to the personal account of the User whose registration is necessary for the use of the Service and to which he can connect on the site by means of his credentials to consult and manage a set of information concerning him on the website, in particular their personal data, the history of their purchases made on the website, their delivery addresses, etc.
Credentials	Refers to the username and password chosen by the User and allowing him to connect to his User Account to access all or part of the Service.
Registration	Refers to the online registration procedure on the website that the User must complete to use all or part of the Service, and resulting in the creation of the credentials and the User Account.
Service fees	Refers to the costs of the Service subscribed by the user including, for example, but not limited to: delivery costs, product customization costs when offered, etc.
Service	Refers to the service offered on the website by OZERTY for the conclusion of one or more subscriptions via the site.
Site	Refers to the website https://ozerty-canada.com which allows you to consult current consumer goods and which allows you to buy them and have your purchases delivered.
User	Refers to any adult or legal person registered on the Site and subscribing to the Service, if applicable.
Visitor	Refers to any natural or legal person accessing the Site for consultation purposes and not having a User Account.
Subscription	Refers to the subscription program offered by Ozerty.
Subscriber	Refers to any user having subscribed to the service.
Ozerty No Limit	Refers to the subscription program name offered by Ozerty.

 

ARTICLE 2 : Acceptance of the terms and conditions of use

These T & Cs govern the access by Users to the Subscribed Service offered on the Site (Ozerty No Limit). Subscribing to the service means acceptance of the Terms and Conditions of Use of the Service described herein.

Any registration and / or subscription to free or paid Services, as the case may be, implies unreserved acceptance by the User of the provisions of the T & Cs that he expressly acknowledges having read, understood and accepted beforehand.

Subscription is done through a checkbox when the User is plaving a purchase for the first time ("Subscribe to Ozerty No Limit").

The current version of the T & Cs is available at any time and freely accessible on the Site. OZERTY may modify the T & Cs at any time depending on certain technical, economic, legal or commercial constraints, such as the launch of new services.

Users are informed of changes to the T & Cs within a reasonable time. Where applicable, they are informed when they log in to the new T & Cs in force and must accept them to continue to benefit from the Services.

Failing this, the User may unsubscribe, this unsubscription taking effect upon receipt of the User's last order for any order made before the modification of the T & Cs.

Any derogation from the T & Cs, to be valid and binding on OZERTY, must be the subject of a written document signed by OZERTY and the User and expressly referring to the T & Cs.

 

OZERTY reserves the right to suspend any subscription or immediately cease its Services for the benefit of a User, in particular if he violates a provision of the T & Cs.

A printed version of the T & Cs as well as any information sent electronically will be admitted in any legal proceedings concerning the application of these T & Cs, in the same way and under the same conditions as any other document written and kept in paper format.

The fact that OZERTY does not exercise, at any time, a prerogative recognized by these T & Cs, or of not requiring the execution of any stipulation of the agreement resulting from said T & Cs may under no circumstances be interpreted, nor as a modification of the contract, nor as an express or tacit waiver of the right to exercise said prerogative in the future, or of the right to demand the scrupulous execution of the commitments entered into herein.

In case of non-acceptance of the T & Cs stipulated in this contract, the User must renounce benefit from the service subscribed on the site.

ARTICLE 3 : The subscription

By subscribing to Ozerty No Limit, the subscriber accept to pay CA$0.39+tax per day (paid CA$47+tax every 4 months). In return, the subscriber unlock a 40% OFF discount on the whole website (cumulate with any discounted price on the website), Free Standard Shipping all year, and dedicated priority customer service. While the subscription is active the subscriber will enjoy the benefits. If the subscription ends, the benefits are lost until the subscription is active again.

ARTICLE 4 : Free trial

When subscribing to the service, the subscriber have 6 (six) days of free usage of the entirety of the service, after what, unless the cancelation of the service has been explicitly requested by the subscriber the service is due to be paid.

ARTICLE 5 : Payment

At the end of the free trial, a charge of CA$47+tax will be debited from your preferred payment method. In the event of a delay in the acceptation of the payment, a payment failure or any circumstances that disallow the payment to go through, the subscription will immediately ends and all benefits will be lost.

ARTICLE 6 : Cancelation

The subscription is a non-binding service. It can be interrupted at any time. The subscriber can request the cancellation of the subscription at any time by requesting the cancellation via email at contact@ozerty-canada.com.

If less than 30 days has passed between the last charge and the cancellation request, and the subscriber did not use any of his benefits, a full refund of the last payment can be claimed.

In the event of the any benefit being used during the first 30 days, the first month is consumed and cannot be refunded, only the remaining period of the month can be refunded.

After the first 30 days, the subscriber can request a refund for the remaining period of the subscription. Any started month is a due month and cannot be refunded. For instance, If after 33 days the subscriber wish to stop his subscription, he can request a refund of CA$0.39 x 87 days : $33.93+tax.

If a cancellation request is received by email, any new payment that may occurs after the date will be refunded automatically. 

All refunds shall be issued within no more than 14 business days.

ARTICLE 7 : T & Cs modifications

OZERTY reserve the right to edit those conditions at any time, All modification shall be notified 30 days minimum before the modification takes effect, to the subscriber. If the subscriber does not accept the new T & Cs, the subscriber can request a cancellation of the subscription following the procedure above. 

ARTICLE 8 : Responsibility limits

The service is provided "as is" and "as available" without warranty of any kind.

OZERTY cannot be held responsible for the unavailability of a product, or if the product purchased is not meeting the subscriber expectations.

ARTICLE 9 : Personal datas

By subscribing to Ozerty No Limit, the subscriber herein accept OZERTY's usage of the personal data in accordance to the Privacy policy of the website.

ARTICLE 10 : Applicable right

These T & Cs are governed by Canadian (QC) law.

Any complaint must be sent within a maximum of thirty (30) days after the execution or the planned date of execution of the Service subscribed by the subscriber to the following address:

In the absence of an amicable resolution of a dispute between the parties, the Canadian courts will have sole jurisdiction to hear it.
