Subscription's T&Cs

The website (hereinafter referred to as "OZERTY"), is published at the address https://ozerty-canada.com.
ARTICLE 1: Definitions
In order to facilitate the readability of these Subscription Terms & Conditions, the following terms will always have the meaning and scope conferred on them in this article.

| Credentials | Refers to the username and password chosen by the User and allowing him to connect to his User Account to access all or part of the Service. |
| Service | Refers to the service offered on the website by OZERTY for the conclusion of one or more subscriptions via the site. |
| Site | Refers to the website https://ozerty-canada.com which allows you to consult current consumer goods, buy them and have your purchases delivered. |
| User | Refers to any adult or legal person registered on the Site and subscribing to the Service, if applicable. |
| Subscriber | Refers to any user having subscribed to the service. |
| OZERTY Wallet / Store Credit | A commercial benefit with no monetary value, credited to the Subscriber's account and usable as a discount on eligible purchases. |
| Billing cycle | The recurring 28-day period for which the subscription is billed (rolling cycle, not matching the calendar month). |
| Ozerty VIP | Refers to the subscription program offered by Ozerty. |
ARTICLE 2: Acceptance of the terms and conditions
These T & Cs govern the access by Users to the subscription Service offered on the Site (Ozerty VIP). Subscribing to the service means acceptance of these Terms and Conditions.
Subscription is completed at the time of payment, by adding the VIPWELCOME5 offer to your order via the "Apply offer" button. This offer grants you 5% off your order, a C$7 credit toward a future order, and activates your VIP subscription. By adding this offer and confirming your payment, you acknowledge having read, understood and accepted these T & Cs.
The current version of the T & Cs is available at any time and freely accessible on the Site. OZERTY may modify the T & Cs at any time depending on certain technical, economic, legal or commercial constraints, such as the launch of new services.
Users are informed of changes to the T & Cs within a reasonable time. Where applicable, they must accept the updated T & Cs to continue benefiting from the Services. Failing this, the User may cancel the subscription as described in Article 6; orders already placed before the change remain honored under their original conditions.
Any derogation from the T & Cs, to be valid and binding on OZERTY, must be the subject of a written document signed by OZERTY and the User and expressly referring to the T & Cs.
OZERTY reserves the right to suspend any subscription or immediately cease its Services for the benefit of a User, in particular if he violates a provision of the T & Cs.
A printed version of the T & Cs as well as any information sent electronically will be admitted in any legal proceedings concerning the application of these T & Cs, in the same way and under the same conditions as any other document written and kept in paper format.
The fact that OZERTY does not exercise, at any time, a prerogative recognized by these T & Cs may under no circumstances be interpreted as a waiver of the right to exercise said prerogative in the future.
In case of non-acceptance of the T & Cs, the User must renounce benefiting from the subscription service offered on the site.
ARTICLE 3: The subscription
By subscribing to Ozerty VIP, the subscriber agrees to pay C$45 per 28-day billing cycle. In return, the subscriber receives:
- at subscription, via the VIPWELCOME5 offer: an immediate 5% discount on the subscription order and a C$7 welcome credit, usable on any order of C$30 or more and valid as long as the subscription is active;
- a recurring C$60 store credit added to the OZERTY Wallet for each paid billing cycle, usable on any order of C$30 or more;
- access to member-only promotions, priority customer service, and other benefits that may be introduced.
Store credit is granted as a commercial benefit; it is personal, has no monetary value, and cannot be converted to cash or refunded. It applies to the price of eligible items only, and does not cover shipping, taxes or other service fees, which remain payable at checkout by your payment method. The cycle credit is granted after each successful payment and accumulates on the account. Unused credits are kept as long as the subscription remains active. The minimum order to use a credit is C$30.
Benefits are available only while the subscription is active. Upon cancellation or cancellation for non-payment, all unused credits are immediately and permanently lost.
ARTICLE 4: Free trial
Every new subscriber receives a 28-day free trial on their first subscription, with access to all VIP benefits, including the welcome credit and the cycle credit.
If the subscriber cancels during the free trial, the benefits end immediately and no amount is charged.
At the end of the 28 days, unless cancellation has been requested before that date, the subscription becomes paid and the payment method is charged C$45. A reminder email is sent before this first charge.
ARTICLE 5: Payment
The subscription is C$45 per 28-day cycle, charged automatically each cycle starting at the end of the free trial. The cycle is 28 days and does not match the calendar month. By subscribing, you authorize OZERTY to charge the applicable fees to the payment method used at subscription, each cycle, unless the subscription is cancelled or a renewal is skipped.
In the event of a failed charge, OZERTY automatically retries up to 3 times over a 14-day period; if payment still fails, the account is suspended and then cancelled, and unused credits are lost.
ARTICLE 6: Cancellation
The subscription is a non-binding service and can be cancelled at any time. You can cancel online from your account portal (via the "My Account" button at the top of the site, or directly at https://secure.ozerty-canada.com/portal), or by email at contact@ozerty-canada.com. Online cancellation takes effect immediately; email requests are confirmed within 2 business days. Upon cancellation, access to all VIP benefits ends and all unused store credit is immediately and permanently lost.
ARTICLE 7: Skip a renewal
You may choose to skip an upcoming renewal, avoiding the C$45 charge and waiving the related C$60 credit for that cycle.
You can access your account portal via the "My Account" button at the top of the site, or directly at https://secure.ozerty-canada.com/portal. This is where you can skip a renewal and cancel your subscription.
7.1 Timing. The request must be submitted at least 7 days before the next charge date. Within the 7 days before the charge, the option remains visible in your account but can no longer apply to the imminent cycle; it will then apply to the following cycle.
7.2 How to do it. You can skip a renewal from your online account, or by email at contact@ozerty-canada.com. A confirmation is sent once the request is processed.
7.3 Consecutive skipped renewals. You may skip several consecutive renewals, with no annual limit. Skipping a renewal does not cancel your subscription: it automatically resumes at the next non-skipped cycle.
ARTICLE 8: Refund Policy
As a general rule, subscription fees are not refundable once a cycle has been billed. As a commercial gesture, however, if you cancel without having used any VIP benefit (no discount and no store credit applied to an order) over the period concerned, you may request a refund of the corresponding payments made over the last 120 days.
Any benefit used, even partially, makes the cycle in which it was granted non-refundable. Store credit already spent is never refundable. To request a refund, contact contact@ozerty-canada.com within 30 days of your cancellation and confirm that no benefit was used over the periods concerned. Approved refunds are issued within no more than 14 business days to the original payment method.
If you believe a charge was made in error, contact us at contact@ozerty-canada.com within 7 days of the transaction date.
ARTICLE 9: T & Cs modifications
OZERTY reserves the right to edit these conditions at any time. Any substantial modification is notified at least 30 days before it takes effect. If the subscriber does not accept the new T & Cs, the subscriber can cancel the subscription following the procedure above.
ARTICLE 10: Responsibility limits
The service is provided "as is" and "as available" without warranty of any kind. OZERTY cannot be held responsible for the unavailability of a product, or if the product purchased does not meet the subscriber's expectations. Nothing in these T & Cs excludes, restricts or modifies any right, guarantee or remedy that applies to you under applicable consumer protection legislation, including the Quebec Consumer Protection Act, and that cannot lawfully be excluded.
ARTICLE 11: Personal data
By subscribing to Ozerty VIP, the subscriber accepts OZERTY's usage of personal data in accordance with the Privacy Policy of the website.
ARTICLE 12: Applicable law
These T & Cs are governed by the law applicable in Quebec, Canada. Any complaint must be sent to contact@ozerty-canada.com. In the absence of an amicable resolution of a dispute between the parties, the Canadian courts will have jurisdiction to hear it.
